Summary of Case:

"Ashwin Lata was wrongly convicted in 2015 of damaging property in Rakiraki, Fiji. Lata's prosecution was based on his alleged damaging of property belonging to a tenant who had failed to pay his rent. After his conviction following a bench trial in the Rakiraki Magistrate Court, Lata was sentenced to six months imprisonment suspended pending good behavior. Lata appealed. In June 2017 the Fiji High Court quashed and set-aside Lata's conviction on the basis the prosecution failed to introduce sufficient evidence that Lata, and not either the tenant or another person had damaged the tenant's property."
