Summary of Case: |
"Chol Soo Lee was wrongly convicted in 1974 of first-degree murder in San Francisco, California. Lee's conviction was affirmed on direct appeal. His post-conviction petition was granted and a new trial ordered based on evidence the eyewitness identification of him was erroneous, and the prosecution failed to disclose exculpatory evidence. Lee was acquitted by a jury in 1982 after his retrial. The new evidence that resulted in Lee's exoneration was discovered during the investigation of Lee's killing of a fellow inmate for which he was convicted in 1977. Lee's conviction for killing the inmate was overturned on appeal due to a faulty jury instruction, and he was released from prison in 1983. Later in 1983 he pled guilty to a reduced charge in the inmate killing in a plea deal for a sentence of time served." |
