Summary of Case:

"Anthony Lewis was wrongly convicted on August 26, 1986 of aggravated robbery and aggravated battery in Hamilton County, Ohio. Lewis prosecution was based on the victim of a home invasion who was robbed, beaten, and tied up by two men on June 2, 1986 in Cincinnati, Ohio. The men pulled his shirt over his face, so the victim, Albert Weston, identified Lewis solely by voice identification that he sounded like one of his assailants. Lewis waived his right to a jury trial, and presented an alibi defense. Lewis was a parolee living at the Talbert House, a half-way house. After a bench (judge only) trial, Lewis was convicted and sentenced to 10 to 25 years in prison. His motion for a new trial based on an affidavit for a Talbert House employee who drove him to a job interview on the morning of June 3 was denied by his trial judge. The Ohio Court of Appeals affirmed his conviction in April 1988. Lewis filed a federal writ of habeas corpus in 1992 that claimed his trial attorney provided ineffective assistance of counsel by failing to call the employee to testify at his trial, as well as the man at a roofing company who interviewed Lewis for a job. The federal judge conducted an evidentiary hearing and in November 1994 granted Lewis petition on the basis his lawyer was ineffective for failing to call the witnesses to testify at trial. While the State's appeal of the judge's ruling was pending, Lewis was released on parole. The State subsequently withdrew its appeal on May 4, 1995 and its motion to dismiss the charges against Lewis was granted. Ward filed a claim for compensation under Ohio's wrongful imprisonment statute. On December 23, 1996 the Ohio Court of Claims awarded Lewis compensation of $280,471.20."
