Summary of Case:

"Wrongly convicted at age 26 in April 1997 of structuring currency transactions to avoid reporting requirements. In March 1999 the federal Ninth Circuit Court of Appeals reversed Lindberg's conviction based on lack of proof he acted with criminal intent. Lindberg then filed a claim under the Hyde Amendment to recover his legal costs and fees alleging that the government's prosecution of him was vexatious, frivolous, or in bad faith. A US District Court judge denied Lindberg's claim on the basis that the government's prosecution of him without sufficient proof to sustain his conviction on appeal didn't constitute evidence that the government prosecuted him vexatiously, frivolously, or in bad faith. The Ninth Circuit upheld the judge's denial of Lindberg's claim."
