"Anthony Looney was wrongly convicted on April 11, 2017 of failing to obey a traffic control device in Nassau County, New York. Looney appealed, arguing that the trial judge had erred in a written order on August 26, 2016 denying his motion to dismiss the charge. Looney's conviction was reversed and the charge ordered dismissed on May 7, 2020 by the New York State Supreme Court Appellate Term, Second Department, 9th & 10th Judicial Districts. The Court ruled that as a matter of law the traffic information charging Looney with failing to obey an unspecified traffic control device was facially insufficient to allege facts that he had "committed the offense ... charged." The Court ruled: " Consequently, as the simplified traffic information was insufficient, the judgment convicting defendant of violating Vehicle and Traffic Law § 1110 (a) must be reversed and the accusatory instrument charging this offense dismissed.""
