"Fred Mmembe was editor-in-chief of The Post newspapers in Zambia when he was wrongly convicted of contempt of court and sentenced to four months imprisonment with hard labor. The newspaper was also convicted and fined K135,000 and sentenced to four months imprisonment -- to be served by M'membe concurrently with his sentence. Mr Mmembe allegedly committed the contempt of court when the newspaper published an article touching on a case in which former Post news editor Chansa Kabwela was charged with circulating obscene matters. The article was entitled -- "The Chansa Kabwela case: a comedy of errors." M'membe appealed and on April 2, 2012 the Lusaka High Court quashed his conviction, ruling that there was no evidence to prove that he masterminded the publication of the offending article. The newspapers conviction and fine of K135,000 was upheld since the article was published." |
