"Lieselotte C. Maerz was wrongly convicted on October 28, 2004 of misdemeanor disorderly conduct for unreasonable noise in Lancaster County, Pennsylvania. Maerz was convicted based on the prosecution's evidence that she yelled across the street at her neighbor who was flashing a light on her home on an evening in December 2003. After her conviction following a bench trial the 70-year-old Maerz was fined $50 and ordered to pay $117 court costs by the district judge. Maerz appealed. On July 20, 2005 the Superior Court of Pennsylvania reversed Maerz' disorderly conduct conviction on the basis the prosecution failed to introduce sufficient evidence proving beyond a reasonable doubt she had caused a public disturbance, and that her noise level in shouting at her neighbor "was absolutely inconsistent with the residential neighborhood's tolerance levels or standards." The appeals court stated Maerz' "brief outdoor vocal outburst did not breach the public peace through unreasonable noise in violation of 18 Pa.C.S.A. § 5503(a)(2)."" |
