Summary of Case:

"Donovan Mais was wrongly convicted on November 24, 2010 of attempting to rape a woman in Rockland County, New York. During Mais' jury trial the prosecution introduced testimony from the alleged victim that her "assailant" yelled at her "take your clothes off," but he never touched her, he didn't make a verbal demand to have sexual intercourse with her, none of her clothes were removed, and the man didn't undress. Mais appealed. On November 12, 2015 the New York State Supreme Court Appellate Division, 2nd Department reversed Mais' attempted rape conviction based on the prosecution's failure to introduce insufficient evidence he committed the crime, and orderied dismissal of charge. Mais asserted his innocence of his companion second degree burglary and third-degree attempted robbery.convictions on the basis he was misidentified by the woman and there was insufficient evidence he was the person who committed the crimes, but the appeals court affirmed those convictions."
