Summary of Case:

"Andrew Manning was wrongly convicted on November 9, 2006 of murdering Aubrey Whyte on April 25, 2004. Whyte lived in the United States, and he travelled to Jamaica to celebrate his birthday. Whyte was shot dead at his birthday party at Old Harbour Road, St Catherine, Andrew Manning's alibi defense was he was in another town, St. Andrew, at the time of the crime. Manning was convicted on the basis of an eyewitness who said Manning held a pistol an inch from Whyte's head when he shot him. Manning was sentenced to life imprisonment. He would have to serve 27 years before he was eligible for parole. In late July 2009 Jamaica's Court of Appeal overturned Manning's conviction and acquitted him on the basis the eyewitness testimony relied on to convict him was irreconciably contradictary with the forensic testimony of the consultant pathologist Dr Ere Seshaiah. The doctor testified the there was no gunpower marks around the gunshot injury to Whyte's head, which indicated the distance between the muzzle of the gun and his head was two feet or more. The appeals court ordered Mannings acquittal and his immediate release. He had been incarcerated for more than five years from the time of his arrest."
