"John Daniel Manning was wrongly convicted of recless or culpable negligence in being involvedi n a traffic collision in Dutchess County, New York. On March 9, 1959 his conviction was overturned on appeal and his indictment ordered dismissed on the basis the jurdge erroneously charged the jury about the presumption of guilt created by the Manning's blood test, which was the only evidence the prosecution presented he committed a crime. John Manning was going at a moderate rate of speed with a dirty windshield when he went over the center line, and the evidence of intoxication was contested."
