Summary of Case: |
"Jennifer Megan Mau was wrongly convicted of making a false insurance claim for water damage to personal belongings incurred when she and her boyfriend David Eden rented a U-Haul truck to move from Centralia, Washington to Morton, Washington in March 2007. After the move that was made during constant rainfaill, Mau and Eden submitted a claim for $16,000 worth of damage caused by a leaking roof in the rental truck. Their claim was denied, and on March 17, 2010 Mau and Eden were each charged with one count of submitting a false insurance claim and/or proof of loss. Mau and Eden were tried together. Afte they were both convicted Mau was sentenced to 60 days electronic home confinement and Eden to 15 days home confinement. Mau and Eden appealed on the basis the prosecution had introduced insufficient evidence to prove they made a false insurance claim. After their convictions were affirmed by the Washington Court of Appeals, Mau only petitioned the Washington Supreme Court for review, which was granted. On August 23, 2013 the Washington Supreme Court ruled En Banc that the State had introduced insufficient evidence to support Mau's conviction, and ordered that her conviction be reversed and the complaint dismissed. Since Mau and Eden was convicted of the same charge based on identical facts, Eden may petition to have his conviction vacated on the basis of the Court's ruling in Mau's case." |
