Summary of Case:

"James Arthur Mavromatis was wrongly convicted on October 21, 2013 in federal court in Ketchikan, Alaska after a bench (judge only) trial of being in possession of a firearm after being committed to a mental institution. The judge had denied Mavromatis' motion to dismiss the indictment on the basis his prosecution violated his constitutional right against double jeopardy. On June 10, 2014 U.S. District Court Judge Timothy M. Burgess sentenced Mavromatis to serve three years in federal prison, to be followed by three years of supervised release, and to page a $100 special assessment. Mavromatis appealed. On October 28, 2014 the Ninth Circuit Court of Appeals vacated Mavromatis' conviction and ordered dismissal of his indictment on the ground it was barred by double jeopardy because he was previously acquitted on a charge of being a felon in possesion of a firearm based on the same incident of possession. Mavromatis was arrested on July 18, 2013, and he was released on October 29, 2014 -- the day after the appeals court's ruling."
