Summary of Case:

"Chadwick McGhee was wrongly convicted in 2014 of simple kidnapping in the disappearance of Jessica Guillot, who was last seen in Simmesport, Louisiana on September 7, 2013, and she has not been seen since. McGhee was indicted on November 14, 2013 of one count of second-degree kidnapping. During his trial testimony was presented that McGhee may have been present when Guillot was kidnapped, but no testimony was presented that he participated or had any prior knowledge. After his conviction by a jury McGhee filed a pre-sentence motion for a new trial that asserted,, among its grounds, that the jury's verdict was unsupported by the evidence. After the judge denied McGhee's motion, on November 12, 2014 he was sentenced to life in prison without parole as a habitual offender. McGhee appealed. On November 4, 2015 the Louisiana 3rd Circuit Court of Appeal reversed Chadwick McGhee's conviction on the basis the prosecution introduced insufficient evidence to prove he was involved in the kidnapping or to prove the essential element that he had the intent to commit kidnapping. The Court's ruling noted that McGhee committed no crime, because, "At most, the State proved that Defendant was present when the victim was kidnapped and failed to stop the kidnapping or report it to authorities, so-called misprision of a felony. However, while misprision may be unsavory, it ceased to be a crime in Louisiana after 1942.""
