Summary of Case: |
"Marwin T. McHenry was wrongly convicted in 2013 of assault with intent to murder, felonious assault, and felony firearm possession related to a shooting in 2012 in Detroit, Michigan. McHenry's prosecution was based on the testimony of three eyewitnesses, including a woman shot in the knee, that he was the shooter. After his conviction by a jury McHenry was sentenced to 16 to 27 years in prison. A post-conviction investigation of McHenry's case by the Wayne County District Attorney's Office resulted in two people telling an investigator in 2014 that another man had confessed to being the shooter, and three people testified under investigative subpoenas in 2015 that same man was the shooter. On May 1, 2017 the motion by the Wayne County District Attorney's Office to dismiss the charges against Marwin McHenry based on a confession by the actual culprit was granted. On August 16, 2017 McHenry was awarded compensation of $175,753 by the State of Michigan under the state wrongful imprisonment compensation statute enacted in 2017." |
