"Steve Dell McNeill was wrongly convicted in 2014 in Las Vegas, Nevada of violating conditions of his lifetime supervision as a sex offender by refusing to submit to a urinalysis, failing to report, failing to obtain residence approval, failing to cooperate with his supervising officer, failing to maintain full-time employment, failing to abide by a curfew, and being terminated from his sex offender counseling. McNeill's prosecution was based on his refusal in August 2013 to continue to abiding by the conditions of his lifetime supervision as a sex offender that began in 2008. McNeill had been homeless for over a year and was living on the street in various areas of Las Vegas, when he sent a cease and desist letter to the Nevada Division of Parole and Probation stating that it had no authority over him, and that it should discontinue contacting him. In March 2014 McNeill was charged with violating multiple conditions of his lifetime supervision, and committing prohibited acts by a sex offender. On July 28, 2016 McNeill's convictions were reversed by the Nevada Supreme Court ruling en banc that he was convicted of actions that the Nevada State Parole Board had imposed without authority of the Nevada Legislature as set forth in NRS 213.1243. Those illegal condition McNeill had been convicted of violating were: refusing to submit to a urinalysis, failing to report, failing to cooperate with his supervising officer, failing to maintain full-time employment, failing to abide by a curfew, and being terminated from his sex offender counseling. McNeill was barred from being retried for those lawful actions. The Court did rule that McNeill could be retried only for failing to obtain residence approval -- the only thing the parole board had authority to monitor." |
