Summary of Case:

"T. Meganathan was co-defendant of his brother, Gunalan Meganathan. The brothers were wrongly convicted of assaulting a man in November 2006. During their December 15, 2006 trial in the Sessions Court both defendants testified on their behalf, but neither was cross-examined by the prosecution. Gunalan was sentenced to six months imprisonment, and his brother T. was sentenced to six months imprisonment. The Meganathan brothers appealed and their convictions were overturned on May 17, 2007, because the failure of the prosecution to cross-examine them meant that their defense was unchallenged and in and of itself that created reasonable doubt of their guilt."
