Mersereau was sentenced to 18 to 24 years in prison. On September 26, 2012 the Wyoming Supreme Court reversed Mersereau's conviction of second-degree sexual abuse on the basis of insufficient trial evidence to prove his guilt beyond a reasonable doubt. The Court's ruling stated: "After a careful review of the record, we agree that the State failed to provide sufficient evidence to sustain the appellant's convictions for second-degree sexual abuse."
