Summary of Case:

"Jeffrey Wayne Miller was wrongly convicted on October 21, 2014 of misdemeanor lascivious conduct with a 17-year-old girl, D. P., at a lake in Tama County, Iowa on July 23, 2014. The prosecution's case was based on eyewitness evidence that the 37-year-old Miller and D.P. were seen in public standing close together and kissing with her pants partially unzipped, although he wasn't seen touching her with his hands. During his trial D.P. testified that she initiated the kissing, they had no sexual contact, and they were not in a relationship. District Court Judge Ian K. Thornhill denied a motion for a judgment of acquittal at the close of the prosecution's case. After Miller's conviction by a jury Judge Thornhill also denied a motion for a new trial. Miller was sentenced on December 18, 2014 to two days in jail with credit for time served, he was fined $315, and assessed court costs totaling $7,960. Miller appealed. On April 6, 2016 the Iowa Court of Appeals reversed Miller's conviction and ordered dismissal of the charge. The appeals court ruled the prosecution's case was based on speculation and insufficient evidence was introduced to prove Miller's guilt beyond a reasonable doubt, and that Judge Thornhill erred in denying Miller's motion for a judgment of acquittal."
