Summary of Case:

"Linda Miller was one of the Wenatchee 43. Miller was arrested on allegations of 3,200 counts of child rape on March 25, 1995 after an all night interrogation session by infamous Wenatchee detective Bob Perez. She was convicted in 1995 of eight felony counts of child rape based on the prosecution's portrayal of her statement as a confession, and she was sentenced to 33 years in prison. Her conviction was reversed by the Wash. Ct. of Appeals on the grounds the trial judge made two prejudical errors: First, the judge erred not allowing Miller to call an expert false confession witness. Second, the judge erred not allowing testimony at her trial about the acquittals and dismissed charges against other defendants charged with similar offenses as Miller. The Chelan County prosecutors office refused to immediately dismiss the charges. To be released from prison and return to her children, nine months after her felony convictions were overturned she took an Alford plea (no contest) plea to three misdeamenors. Linda Miller was released on March 4, 1998 after three years of imprisonment. A number of other vindicated Wenatchee 26 defendant's were forced into making similar Devil's Pacts with Chelan County Prosecutor Gary Riesen to get released from prison."

Conviction Caused By:

"Misconduct by Chelan County judge T. W. "Chip" Small in permitting Linda Miller to be convicted on the basis of (uncorroborated) hearsay and denying her the ability to counter child abuse allegations with a defense expert witness."

Innocence Proved By:

"In June 1997 the Washington Court of Appeals vacated her convictions of eight felony counts of child rape. The prosecutor refused to immediately dismiss the charges, and nine months later she was released on March 4, 1998 after she pled no contest to three misdemeanor counts of communicating with a minor for immoral purposes."
