Summary of Case:

"Zuki Mohd was wrongly convicted on December 19, 2005 of raping a 17-year-old National Service Training Programme that he coached in the city of Kuala Terengganu, in the Malaysian state of Terengganu. The case was he said, she said. The prosecution's case was based on the "victims" testimony that on February 28, 2004, Zuki Mohd raped her in a car. Mohd admitted having sex with the young woman, who was of legal age, but he contended it was consensual. Mohd was sentenced by the Sessions Court to 12 years imprisonment and three strokes of the rotan. Mohd appealed and on October 27, 2009 the Terengganu High Court acquitted and ordered the release of Zuki Mohd on the basis there was insufficient evidence he committed the crime, or that the alleged rape occurred. The Court based its ruling on the unreliability of the alleged "victims" testimony, and that she waited almost two months before reporting the alleged crime. Between the time of the alleged crime and her report, she had even failed to make any mention of having been raped when she was treated by a doctor for chest pain, fever and cough. Her credibility was also undermined because she falsely testified that a camp officer had stopped her from lodging a police report, she had disposed of the panties she wore during the alleged rape, and she didn't complain to anyone, and even though she said she violently fought against Mohd, no one observed any bruises and scratches that she allegedly experienced while fighting against Mohd. Zuki Mohd was wrongly imprisoned for 3 years and 10 months."
