Summary of Case: |
"Kevin Moonsammy was wrongly convicted in 2016 of raping his three-year old granddaughter on December 26, 2015 in Bulawayo, Zimbabwe. Moonsammy's prosecution was based on a complaint filed by the child's mother on January 12, 2016. A woman was babysitting the girl on the night of the alleged rape. The woman told the girl's mother that her daughter was walking funny and she thought there could be sperm on her panties and private parts. The prosecution alleged that he raped the girl in the evening while her mother was gone. Moonsammy's defense was to deny the accusation. The police did no investigation beyond taking the statements of the babysitter and the mother. After his conviction Moonsammy was sentenced to 16 years in prison. Moonsammy appealed. On October 27, 2017 Bulawayo High Court Justice Francis Bere quashed Moonsammy's conviction and ordered his acquittal on the basis the proseuction failed to introduce sufficient evidence he committed the crime. Justice Bere also criticized the police for failing to investigate the alleged crime and use DNA testing on the alleged evidence to determine if it was in fact sperm, and if so, if it matched Bere." |
