Summary of Case:

"William Gary Mosley was wrongly convicted in December 2014 of felony manufacture of methamphetamine and two misdemeanor counts of possession of drug paraphernalia in Marion County, Tennessee. The trial judge denied Mosley's pre-trial motion to suppress the evidence of what he argued was an illegal search of his home on March 12, 2014, because the police affidavit relied on to issue the search warrant, didn't state sufficient probable cause. Mosley then agreed to plead guilty conditioned on his right to appeal the issue of the search warrants legality. On January 26, 2016 the Tennessee Court of Criminal Appeals reversed Mosley's conviction in ruling, "Based upon the oral arguments, the record, and the parties’ briefs, we conclude that the affidavit failed to establish probable cause for the search warrant. Therefore, the judgment of the trial court is reversed, the appellant’s convictions are vacated, and the charges are dismissed." Tennessee v. Mosley, No. M2014-02533-CCA-R3-CD (Tenn. COA, 1-26-2016)"
