Summary of Case: |
"Chris Mubiru was wrongly convicted on September 8, 2015 of sodomizing a man in 2009 in Mengo, a suburb of Kampala, Uganda. Mubiru, the former manager of the Ugandan national soccer team, was prosecuted based on videos leaked to a tabloid in Kampala that allegedly showed Mubiru having sex with the several different people at his home, although none of the people in the video could be identified. In December 2009 the tabloid published a story with still photos from the video. in 2014 Uganda enaced tough anti-homosexual laws, and Mubiru was prosecuted. Mubiru denied the charges, but a man who claimed he was in the video testified he was drugged and then subjected to unconsenting homosexual activity. After his conviction Mubiru was sentenced to 10 years in prison and ordered to pay restitution of 50 million Ugandan shillings (about $15,000) to the alleged victim. Mubiru appealed. On April 19, 2016 Uganda's High Court reversed Mubiru's conviction on the basis insufficient evidence of his guilt was presented by the prosecution, because there was no substantial evidence of penetration. The court noted that the medical evidence did not support the alleged "victim" had homosexual relations, and that the video did not show penetration." |
