Summary of Case: |
"Shuah Mudiwa and his co-defendants, his brother Takudzwa Mudiwa and Patricia Chikide Mwashuma, were wrongly convicted in 2009 of kidnapping a 12-year-old boy in Mutare, Zimbabwe. They were sentenced to 7 years in prison. They appealed, and in December 2010 a panel of High Court judges overturned their conviction, ruling that the trial judge improperly shifted the burden of proof to the three defendants to prove their innocence. Shuah Mudiwa, who was a member of the Zimbabwe Parliament, spent two weeks at Mutare Remand Prison before being granted bail." |
