Summary of Case: |
"Shuah Mudiwa and his co-defendants, his brother Takudzwa Mudiwa and Patricia Chikide Mwashuma, were wrongly convicted in 2009 of kidnapping a 12-year-old boy in Mutare, Zimbabwe. They were sentenced to 7 years in prison. They appealed, and in December 2010 a High Court judge overturned their conviction, ruling that the trial judge improperly shifted the burden of proof to the three defendants to prove their innocence. Shuah Mudiwa, who was a member of the Zimbabwe Parliament, spent two weeks at Mutare Remand Prison before being granted bail." |
