Summary of Case:

"Dickson Muganyizi was wrongly convicted of being in possessof property suspected to have been obtained unlawfully. Muganyizi was an officer in the police anti-drugs unit in Dar es Salaam, Tanzania. Muganyizi's prosecution was based on the allegation he and two other officers conspired to break into the anti-drugs unit store, stole 8441.87 grams of cocaine, heroin and cannabis sativa valued at 176,424,970, and that he sold the drugs to businessman Steven Sipuka. He was also charged with unlawful possession of drugs. Muganyizi was acquitted at trial of all those charges, but he was convicted of the lesser offense of being in possession of property suspected to have been unlawfully obtained. Muganyizi was sentenced to three years in prison, and ordered to forfeit his properties that included a house. Muganyizi appealed. The High Court reversed Muganyizi's conviction and ordered his acquittal on the basis the prosecution failed to introduce sufficient evidence of his guilt. However, the High Court didn't vacate the forfeiture order. Muganyizi appealed seeking dismissal of the forfeiture order, and the State appealed his acquittal. In November 2016 the Court of Appeal of Tanzania affirmed Muganyizi's acquittal, and ordered dismissal of the forfeiture order because it could only be valid as a consequence of his conviction so as to deprive him of the financial benefit obtained from a crime. Since he was acquitted of the crime there was nothing to be forfeited."
