Summary of Case:

"Akilah N. Murphy was wrongly convicted in 2012 to second degree possession of heroin with intent to distribute and third degree possession of heroin with intent to distribute within 1000 feet of a school zone in Union County, New Jersey. Murphy was sentenced to four years in state prison. Murphy conditionally pled guilty by reserving the right to appeal after the judge denied her motion to suppress the evidence collected by the police during a warrantless search of her residence without permission. The trial judge ruled that the warrantless search was justified because their were exigent circumstances excusing the police officer's failure to attempt to obtain a warrant. Murphy appealed arguing the judge erred in denying her suppression motion. On June 3, 2015 the New Jersey Court of Appeals reversed Murphy's conviction on the basis the evidence relied on to convict her was obtianed in an unconstitutional search without a warrant and that was undertaken by the police without exigent circumstances."
