Summary of Case:

"Emanuel Muscat was wrongly convicted in 2013 of illegally trapping near Dingli, Malta on November 4, 2012. Muscat's prosecution was based on the testimony of a police sergeant that he was found at a site with traps and nets during the closed trapping season. The police testified Muscat admitted the traps and nets were his. Muscat's defense was he was not at the site, and he produced a doctor's certificate showing he was home that day on sick leave. He also denied admitting that the nets that were found were his, although he did admit the traps were his -- but he dened they were set and being used. After his conviction by a magistrate Muscat was fined €700. Muscat appealed. In October 2016 the Malta Court of Appeals overturned Muscat's conviction on the basis the prosecution introduced insufficient evidence to prove his guilt beyond a reasonable doubt."
