Summary of Case:

"Mukhtar Abbas Naqvi was wrongly convicted on January 13, 2015 in Rampur, India of violating the election code in the run-up to the 2009 Lok Sabha polls. At the time of his arrest Naqvi was the Union Minister of State for Parliamentary and Minority Affairs in the Lok Sabha ("Assembly of the People"), which is the lower house of India's Bicameral-Parliament. The charges stemmed from a demonstration in Rampur staged by party workers outside the police station who even tried to barge in, after Naqvi’s convoy was stopped for a police security check and one vehicle was seized for not seeking permission for election canvassing. Naqvi was convicted along with 18 people who were charged with participating in the protest. Naqvi was sentenced by the district court to one year in prison. His sentence was stayed pending the outcome of his appeal. On May 16, 2015 High Court Judge Pradeep Kumar in Allahabad, India issued the Court's ruling that “The criminal appeal filed by Mukhtar Abbas Naqvi is allowed and the judgment and order of January 14 passed by the Additional Chief Judicial Magistrate, Rampur, is set aside.” Naqvi's conviction was overturned on the ground the prosection had “failed” to prove the charges beyond a reasonable doubt. Rampur is in India's Uttar Pradesh state."
