Summary of Case:

"Peter Naudé was wrongly convicted in November 2013 of breaching the code of conduct for the Hibiscus Coast Municipality in South Africa. Naudé was a councillor with the municipality, and his conviction was based on his failure to declare his wife’s shareholding in a company which had been awarded a contract by the municipality. Naudé's defense was that at the time of the alleged breach,his wife, Elsabe, had been seriously ill and had subsequently died. He asserted he had been unable to disclose the particulars of the benefit as he had been unaware of it. After Naudé conviction following a bench trial, he was ordered to pay a fine of R15 000 (Approx. US$1,200), of which R9 000 was suspended. Naudé appealed. On May 26, 2015 Naudé's conviction was set-aside on the basis of insufficient evidence to support his conviction, and he did not have a duty to declare the interest of his wife until he first became aware of it."
