Summary of Case:

"Njabulo Ndlovu was wrongly convicted in 2005 of rape in the gang rape of a pregnant woman in 2002 in Westville, KwaZulu-Natal, South Africa. At the time Ndlovu was a student at the University of KwaZulu Natal’s Westville campus. Ndlovu insisted on his innocence. The victim did not identify him. His prosecution was based on circumstantial evidence. After his conviction by Magistrate Mike Lasich following a bench trial, he was sentenced to life in prison. He appealed. On August 20, 2018 the Pietermaritzburg High Court unanimously reversed Ndlovu's conviction and ordered his acquittal. Judge Rashid Vahed delivered the Court's ruling that DNA evidence did not link Ndlovu to the crime, and the conduct of Magistrate Mike Lasich raised concerns about the fairness of his judgment. After his release NdLovu told reporters: “I always knew the truth would eventually emerge. Being in prison was tough but I knew I had to survive. Worst of all was the effect it had on my parents. I am grateful that they never gave up on me." Ndlovu earned a law degree from Unisa in prison, and said "I wanted to fight against injustices and make a difference in society." Ndlovu said he intends to sue the State for his wrongful arrest."
