Summary of Case: |
"Huynh Van Nen aka Huynh Van Nu was wrongly convicted on August 31, 2000 of murder and robbery in the death of his neighbor, Le Thi Bong, on April 30, 1998 in Ham Tan District, Binh Thuan Province, Vietnam. Nen was arrested on May 17, 1998, and his conviction was based on police testimony that he had confessed to killing her with a rope and stealing her possessions. Nen insisted his confession was coerced. After his conviction Nen was sentenced to life in prison for murder, 3 years for robbery, and 2 years for intentional destruction of property. In November 2014 Vietnam's Supreme Court ordered that Nen's case be reopened. On October 22, 2015 Nen was released on bail for medical treatment. On October 28, 2015 Nen's conviction was overturned. One of the two suspects had died in 2001, but the other was arrested in November 2015 and he confessed to police that he and the other man had committed the crime. On December 3, 2015 authorities of three State agencies in Binh Thuan Province officially apologized to Nen, admitting severe mistakes had been made that resulted in his miscarriage of justice. On April 11, 2016 Nen filed a claim for compensation of VND18 million ($800,000) with a court in Binh Thuan. In late 2016 Nen was paid VND10 million ($US440,000) compensation by Binh Thuan Province for his wrongful imprisonment. The VND10 million award was comprised of: VND5.3bn (USD233,000) for Nen’s mental anguish; VND2.3bn for his health; VND1.2 for his lost income; and VND1.2bn for other losses. On November 28, 2015 the deputy director of Binh Thuan Province Police said that the police have traced the perpetrator in the murder of Le Thi Bong." |
