"Truman Handy Newberry, Paul H. King, and fifteen others were codefendants wrongly convicted on March 20, 1920 of conspiring to violate the federal corrupt practices act by exceed the campaign fund raising limit for Newberry's successful U.S. Senate campain in 1918. Newberry was sentenced to two years in prison and a fine of $10,000. On May 21, 1921 the U.S. Supreme Court reversed the convictions of all seventeen defendants on the basis the U.S. Constitution doesn't allow Congress to regulate primary elections, and the indictment covered the primary and the general election." |
