Summary of Case:

"Sir Peter Newson-Smith was wrongly convicted in May 2013 of two counts of indecently assaulting a former pupil in the early 1980s At that time Newson-Smith was the head of music at boarding school Clayesmore Prepatory School in Dorset, England. Newson-Smith is the 3rd Baronet of Totteridge. The alleged victim testified that Newson-Smith lured him into a cupboard and made him strip naked before molesting him. After the jury convicted Newson-Smith the judge sentenced him to 5-1-2 years in prison. Cartwright, who at the time of the trial was in his 40s, testified he didn't intend to sue to collect money damages for the abuse he alleged. After the trial Cartwright instituted proceedings to sue Newson-Smith and the school, Newson-Smith's appeal raised the issue that his conviction was unreliable because the jury was mislead by Cartwright's testimony that concealed he had a financial motive to be untruthful about his allegations. In January 2014 England's Court of Appeal quashed Newson-Smith's conviction and ordered his release with a retrial based on the allged victim's failure to disclose he planned to sue Newson-Smith and the school for damages."
