Summary of Case:

"Glen Nickerson Jr., aka Buddy Nickerson, was wrongly convicted in April 1987 of a 1984 armed robbery, double homicide and attempted murder in San Jose, California. His conviction was based on an eyewitness identification. Glen Nickerson was sentenced to life in prison. California state court's affirmed Nickerson's conviction on dirct appeal and denied his post-conviction petition. Nickerson filed a federal habeas corpus petition that was granted by U.S. District Court Judge Marilyn Hall Patel on March 17, 2003. Nickerson was freed on bail after almost 18 years in custody. The Santa Clara County District Attorney declined to retry Nickerson, and the DA's motion to dismiss the charges was granted on May 19, 2003. Glen Nickerson filed a federal civil rights lawsuit against Santa Clara County, which was settled in 2005 for $875,000."
