Summary of Case:

"Ashok Nirbhawane was wrongly convicted in May 2012 of raping and murdering a mentally disabled woman on December 26, 2010 in Chandwad, in the Nashik district of India. The prosecution's case was based on the testimony of the victim's brother Sanjay that a month before he found his sister's body in the house they shared, that he saw Nirbhawane trying to force himself on her at their house. Sanjay said he slapped Nirbhawane who then left. Although the prosecution presented no evidence linking Nirbhawane to the woman's rape and murder, the sessions court in Nashik relied on her brother's testimony to find him guilty and sentence him to life imprisonment. Nirbhawane appealed. In April 2014 the Bombay High Court quashed Nirbhawane's conviction and acquitted him based on the prosecution's failure to present evidence proving its case against him beyond reasonable doubt."
