Summary of Case:

"Kevin O'Loughlin was wrongly convicted in February 1983 of kidnapping and raping an 11-year-old girl in Framingham, Massachusetts. O'Loughlin's prosecution was based on his identification by the victim. O'Loughlin was sentenced to 4 to 6 years in prison. Years after his release O'Loughlin discovered evidence that the prosecution failed to disclose that the man who raped the girl was a serial child rapist and kidnapper who had long been known to the Framingham Police Department to have committed a number of similar crimes against young girls similar in age to the girl in the crimes O'Loughlin was charged with, and convicted of committing. Based on the new exculpatory evidence O'Loughlin filed a motion for a new trial that was not opposed by the Middlesex County District Attorney's Office, and which was granted by Middlesex County District Court Judge Kathe M. Tuttman on February 26, 2015. The DA's Office filed a nolle prosequi motion that was granted on March 6, 2015. O'Loughlin filed a federal civil rights lawsuit that named as defendants the Commonwealth of Massachusetts, the Town of Framingham, and several former Framingham police officers. As of March 26, 2017 the lawsuit was still pending."
