Summary of Case:

"Temisan Raymond Omateseye was wrongly convicted on May 20, 2016 of corruption charges in Lagos, Nigeria. Omateseye's prosecution was based on alleged bid rigging and contract splitting when he was the Director General of Nigerian Maritime Administration and Safety Agency (NIMASA). After his conviction of 24 counts, Temisan Omateseye was sentenced to five years in prison. Omateseye appealed. On May 11, 2017 the Court of Appeal Lagos Division set-aside Omateseye's convictions and ordered his acquittal on the basis the prosecution failed to introduce sufficient evidence to prove his guilt. Presiding Judge Justice ?Yargata B. Nimpar stated in the Court's ruling that the trial court did not properly evaluate the evidence, and, "The long and short of it is that, the appeal succeeds. The prosecution should not ride roughshod over the Constitution. The judiciary will do the war on corruption more harm by declaring someone a criminal, where no offence has been committed ? I find merit in the appeal. The lower court judgement is hereby set aside and the appellant is hereby discharged and acquitted.”"
