Summary of Case: |
"Luke Otterstad was co-defendant of Robert Rudnick. Both men were wrongly convicted in 2005 of misdemeanor endangering public safety by holding an anti-abortion sign over a freeway overpass in Anoka, Minnesota on September 21, 2004. They waived a jury trial, and were convicted by a judge based on stipulated facts. Rudnick and Otterstad were both sentenced to 60 days in jail, two years probation, and payment of a $600 fine. On July 12, 2007 the Minnesotta Supreme Court unanimously overturned their convictions, ruling that they were charged under an ordiance that had been superceded by another law, and so their convictions were invalid." |
