Summary of Case:

"John Palladino was wrongly convicted on April 19, 2000 of sexually assaulting a female prisoner at the York Correctional Institution in Niantic, Connecticut where Palladino was the food services supervisor. Palladino's prosecution was based on the woman's statement on March 8, 1998 that she had had sex with him on five separate occasions. The woman was diagnosed with schizophrenia, and she suffered from blackouts and multiple personality disorder. The trial judge denied the request of Palladino for the woman's full psychiatric records, to assist the defense in cross-examining her about the veracity of her allegations. After the jury convicted Palladino of second-degree sexual assault he was sentenced to three years in prison. Palladino was allowed to remain free on bodn pending the outcome of his appeal. On May 14, 2002 the Connecticut Court of Appeal unanimously reversed Palladinio's conviction and remanded for a new trial based on the trial judge's prejudicial error of violating his Sixth Amendment right to confront his accuser by withholding "the complainant's psychiatric records despite a full waiver of confidentiality." And, "After carefully inspecting the exhibits that were withheld from the defendant, we conclude that a constitutional violation has occurred and that the state has not sustained its burden to establish that the violation was harmless beyond any reasonable doubt." State v. Palladino, 69 Conn. App. 630 (Conn. App. Ct. 2002) The New London County District Attorney declined to retry Palladino and the DA's motion to dismiss the charges was granted."
