Summary of Case:

"Anthony Palomino-Coronado was wrongly convicted in November 2013 of one count of violating 18 U.S.C. § 2251(a) by taking a single photo with his cellphone of him having sex with a 7-year-old girl, B. H., on May 3, 2012 at his residence in Laurel, Maryland. Palomino-Coronado, 19 at the time, was a neighbor of B.H. and her family. During Palomino-Coronado's trial the prosecution relied on the photo, the testimony of B.H., and the expert testimony of an FBI child forensic interview specialist. At the close of the prosecution's case Palomino-Coronado's lawyer made a motion for a directed verdict of not guilty based on the prosecution's failure to introduce sufficient evidence to prove that as required by the statute, he was guilty of "knowingly employing, using, persuading, inducing, enticing, or coercing a minor in sexually explicit conduct, for the purpose of producing a visual depiction of that conduct." He argued that no evidence was introduced that his conduct was for the purpose of taking the photo. The judge denied the motion. The jury convicted Palomino-Coronado, and on May 12, 2014 he was sentenced to 30 years in prison, followed by lifetime supervised release, and his registration as a sex offender. Palomino-Coronado made a timely appeal. On November 5, 2015 the U.S. Fourth Circuit Court of Appeals unanimously reversed the trial judges denial of Anthony Palomino-Coronado's motion for a judgment of acquittal, and vacated his conviction based on insufficient evidence to prove his guilt beyond a reasonable doubt."
