Summary of Case:

"Domingo G. Panganiban was wrongly convicted in 2013 of malversation (official misconduct) for failing to immediately return the cash advance he took for a foreign trip that was aborted in 2006, when he was the mayor of Santa Cruz, Laguna, Philippines. His prosecution was based on a P500,000 cash advance received from the town in May 2006 for his planned study trip to South Australia. When the trip was cancelled Panganiban made arrangements with the town accountant to liquidate the advance by withholding his salaries. When Panganiban left office in 2007P256,318.45 was left owing, which he was not able to repay upon demand. Panganiban did later pay off the balance. However, because the money was owing when he left office and he didn't repay it on demand, he was criminally charged with malversation. After his conviction Panganiban was sentenced to serve up to 18 years in prison. Panganiban appealed. On December 9, 2015 the Philippines Supreme Court First Division overturned the conviction of Panganiban on the basis the prosecution failed to introduce evidence that he did not act in good faith by failing to return the cash advance he took for a foreign trip that was aborted. The Court noted that his repayment of the money negated that he had criminal intent to steal the money."
