Summary of Case: |
"David Parse was codefendant of Denis Field, and they were both wrongly convicted in 2011 of federal Mail Fraud and Corrupt Endeavor to Obstruct or Impede the Administration of the Internal Revenue Laws. Parse's prosecution was based on his alleged involvement a scheme to market fraudulent tax shelters that the IRS claimed cost the U.S. Treasury more than $230 million in lost taxes. After his conviction by a jury, but prior to his sentencing Parse and his three codefendants made a motion in July 2011 for a new trial based on juror misconduct. The motion was based on evidence that a woman juror, Catherine Conrad, faked her identity and lied during voir dire to get on the jury. Conrad said she was a stay at home wife when she was actually a suspended lawyer, and she concealed her deep animosity against the defendants who she privately called "fricken crooks and they should be in jail," and that "most attorneys" are "career criminals." The trial judge had denied Parse's motion. Parse was sentenced on March 22, 2013 to 3-1/2 years in prison to be followed by 3 years of supervised release, forfeiture of $1,000,000 and payment of $115,830,267 in restitution. Parse was allowed to remain free on $500,000 bond pending the outcome of his appeal. On June 8, 2015 the U.S. Court of Appeals for the Second Circuit reversed Parse's convictions on the basis that Conrad's dishonesty and presence on the jury irreparably tainted Parse's guilty verdicts. The U.S. declined to retry Parse, and agreed to a one year deferred prosecution agreement. Parse completed the year and his indictment was dismissed on November 23, 2016. The pre-sentencing motion for a new trial by Parse's three codefendants was granted, and they suffered various fates. Denis Field was acquitted on October 31, 2013 after his retrial. Daugerdas was convicted after that retrial of seven counts, including tax evasion and conspiracy. He was sentenced to 15 years in prison. Guerin pled guilty and was sentenced to 8 years in prison." |
