Summary of Case:

"Parvathi was wrongly convicted of murder in the burning death of her daughter-in-law on March 21, 2010 in the Tirunelveli district of the Indian State of Tamil Nadu. Parvathi's prosecution was based on dying declarations of her daughter-in-law that Parvathi set fire to her after Parvathi's intoxicated alcoholic son poured kerosene on her. After Parvathi's conviction she was sentenced to life in prison. Parvathi's sentence was suspended when her appeal to the High Court was allowed in 2014. In October 2016 the Madras High Court set aside the conviction of Parvathi based on insufficient evidence to support her guilt beyond a reasonable doubt because of significant discrepancies in the three dying declarations of the victim regarding her mother-in-law’s involvement. However, the High Court ruled that the victim's declarations were consistent in implicating her husband Senthilkumar in the crime. However, the Court stated that the evidence showed Senthilkumar had lost his mental balance, so the court modified his conviction from murder to culpable homicide not amounting to murder, and reducing his sentence from life in prison to five years in prison and a fine of Rs.1,000 would meet the ends of justice."
