Summary of Case:	"Giovanni Passamonti was wrongly convicted in 2014 of sexual assaulting a woman on a yacht moored at Dunstaffnage Marina, near Oban, Scotland in Argyll in October 2012. Passamonti admitted having sex with the woman, but he said the sex was consensual. During the closing argument the prosecutor repeatedly referred to Passamonti's accuser as the "victim," over the objection of Passamonti's lawyer. After his conviction by a jury, Passamonti was sentenced to serve 300 hours of unpaid community service. On August 20, 2015 the Court of Criminal Appeal in Edinburgh quashed Passamonti's conviction in granting his appeal that wasn't opposed by the Crown's prosecutors. The appeals court ruled that the prosecutors closing argument prejudiced Passamonti's right to a fair trial, and a retrial wasn't ordered."
