Summary of Case:

"Marlon Passley was wrongly convicted of first-degree murder in the shooting of a teenager and the wounding two of the murdered man's friends in the Dorchester Neighborhood of Boston on Aug 11, 1995. At his trial, four witnesses said Passley shot the people while riding by them on a motorcycle. Seven alibi witnesses testified Passley was with them at a graduation ceremony for a cousin in another part of Boston when the shooting occurred. After the jury convicted Passley he was sentenced to life in prison. Passley filed a motion for a new trial based on the discovery of new exculpatory evidence. Passley was released on April 18, 1999 after prosecutors acknowledged there was a "substantial likelihood of a miscarriage of justice" and indicated evidence pointed to another person as the killer. He was wrongly imprisoned for three years. His conviction was overturned in 2000. In 2005 Marlon Passley filed a claim for compensation from the State of Massachusetts under G.L.C. 258D, and his claim was settled in 2007 for $500,000."
