"Cheryl A. Peacock was wrongly convicted of resisting arrest and harassment of a police officer in St. Lawrence County, New York. Peacock appealed. On July 1, 1986 the New York Court of Appeals reversed Finch's convictions on the basis Peacock wasn't committing any crime so the offficer did not have probable cause to arrest her for resisting arrest, and her striking his arm when he was falsely arresting her didn't constitute harassment. The Court stated that New York State Penal Law § 205.30 defines resisting arrest as intentionally preventing or attempting to prevent a police officer "from effecting an authorized arrest," and since Peacock wasn't commiting any crime to be arrested for committing, her arrest wasn't authorized. The Court ordered dismissal of the information charging Peacock with resisting arrest."
