Summary of Case:

"Wrongly convicted in 2000 of illegally re-entering the United States after his deportation to the Dominican Republic in 1994 after a drug conviction. Perez became a U.S. citizen in 1988. Released from federal prison custody on April 9, 2004. The Immigration Service attempted to deport him for a second time. Perez contested the deportation on the grounds he was a U.S. citizen. He also filed a lawsuit in 2005 against the federal BOP and the Dept of Justice claiming their was no legal basis for his prosecution, conviction or imprisonment. Wrongly imprisoned for 3-1/2 years."
