Summary of Case:

"Steve Petkovski was wrongly convicted in August 2007 of wounding with the intent to cause grievous bodily harm, a cook in the restaurant he owned in October 2004. The cook's thumb had been hurt during an altercation, and it was his testimony that the jury relied on to convict Petkovski. In July 2008 the Court of Appeals quashed Petkovski's conviction on the basis that the trial judge had barred testimony that would have revealed to the jury that the alleged victim's injury was minor, and that the trial judge also barred the jury from being told that the alleged victim had three criminal convictions involving violence, which the appeal judges explained would have showed the jury he had a propensity to engage in violence. Consequently the judge's ruled there had been "an unfair trial for Mr Petkovski and thus in justice miscarrying." Petkovski was released in July 2008 after nine months imprisonment. On October 20, 2008 as his retrial was to begin, the prosecution announced it was dropping the charge and the judge dismissed the case."
