Summary of Case:

"Keith Phillips was wrongly convicted in April 2003 of importuning -- asking someone of the same sex for sex. In May 2002 the Ohio Supreme Court ruled Ohio's importuning law was unconstitutional because the same act is legal for heterosexuals. Phillips pled no contest and was sentenced to 4 months in jail. After he was released in August 2003, he learned that he had been convicted of a non-existent crime. In December 2005 the Ohio Court of Appeals vacated his conviction, and his conviction of the same crime in December 2002."
